TYPES OF FELONIES AND PUNISHMENT RANGES

There are four categories of felonies, each with its own punishment ranges.  Below are the categories and examples of each.  The examples are for illustration only:

CATEGORY RANGE OF PUNISHMENT EXAMPLE
First Degree 5-99 years and up to a $10,000.00 fine Murder
Second Degree 2-20 years and up to a $10,000.00 fine Aggravated Assault
Third Degree 2-10 years and up to a $10,000.00 fine

Assault of a Public Servant

State Jail 180 days to 2 years in a State Jail and up to a $10,000 fine POCS

Some crimes may have special punishment ranges and some may be enhanced depending on the factual circumstances.
