A person commits the offense of theft under Texas Penal Code § 31.03 if he or she unlawfully appropriates property with intent to deprive the owner of property. In the case above, the charges that the alleged offender could face would likely depend on the value of the parcel allegedly taken from the home. The LPD Facebook post states the parcel was picked up shortly after delivery.

Some people are occasionally charged with theft crimes as the result of miscommunication between parties. A person may report an item as stolen when it was actually lent out to another party by the owner’s spouse, child, or other relative.

Not all theft crimes have security camera footage to rely on for police assistance, so many cases require eyewitness testimony or other forms of evidence that allow authorities to identify and apprehend alleged offenders. In some cases, alleged offenders accused of theft crimes actually have legitimate ownership claims relating to the property in question.

Texas also allows for alleged victims to pursue civil damages from alleged offenders. Under the Texas Theft Liability Act (TTLA), alleged offenders are civilly liable for damages resulting from alleged theft offenses.

When a person is accused of any kind of theft crime, it is critical to retain legal counsel as soon as possible. Georgetown criminal defense attorney Michael J. Price represents clients accused of all kinds of theft offenses in Williamson County and surrounding areas.
