Family Violence Assault
Dismissed at Trial 

Date: February 2024.
Details: Client was arrested for Family Violence Assault.  We exercised our client’s right to a speedy trial and announced ready on the designated day.  After pre-trial motions and prior to jury selection, the State dismissed the case.

Family Violence Assault

Details: Arrest was made for family violence assault.  Although offers were made to resolve the case without trial, our client maintained his innocence and refused to accept a plea deal.  After picking a jury and arguing several pre-trial motions, the State dismissed the case before any witnesses were called to testify before the jury.

Aggravated Assault with Deadly Weapon

Details: Client was arrested for aggravated assault with a deadly weapon.  After a thorough review of the evidence and investigation into the complaining witness, it became clear that the complaining witness was the aggressor in the events leading to the arrest.  The case received a no-bill at the Grand Jury and was dismissed.

Details: Client found NOT GUILTY by jury.  The evidence at trial established that our client was defending another individual, and as a result the actions leading to arrest were legally justified..

Possession of Firearm by Felon
Acquittal 
Date: December 2021
Details: Client found NOT GUILTY by jury after facing a possible sentence of 25 to life.  The defense centered on a poor investigation by law enforcement and the weakness of the State’s case at trial.

DWI
Dismissed 
Date: March 2023
Details: Client stopped for traffic violation.  Admitted to consuming alcohol, but after a good performance on the Standardized Field Sobriety Tests, refused to provide a breath sample.  Our office recommended against accepting a plea offer or pre-trial diversion.  The case was dismissed off the trial docket by the State.

Family Violence Assault and Criminal Mischief

Date: September 2023
Details: Client was accused of a felony criminal mischief and misdemeanor family violence assault.  Both cases were dismissed through negotiation with the State.

DWI – BAC above .08
Dismissed
Date: February 2020
Details:  Officer claimed several reasons for the initial stop of client.  Portable breath test on scene showed BAC above .08 but lab results of blood taken hours later showed a BAC below .08. After reviewing video of client on scene and negotiating with the prosecutor, the State agreed to dismiss the case.

Injury to Child – Reduced to Misdemeanor

Details:  After a thorough negotiation, the State reduced the charge to a misdemeanor and agreed to allow client to complete Pretrial Intervention Program for a dismissal of all charges and eligibility to expunge the full record.

Possession of Dangerous Drug

Details:  After showing client was a victim of traumatic circumstances and was seeking assistance, State agreed to dismiss.

DWI 2nd – BAC above .15
Reduced Charge
Date: February 2020
Details:  State had a strong case, but after explaining client’s several extenuating circumstances a plea deal for a time served on a reduced charge of a class B misdemeanor was agreed to. No jail time and no probation required.

Assault by Contact (child) – Enhanced to Higher Charge
Dismissed – March 2020
Details:  After reviewing evidence and client taking an agreed educational class, the State dismissed.

Assault Family Violence
Dismissed – March 2020
Details:  After reviewing evidence and providing context of situation, State agreed to dismiss.

Assault Causes Bodily Injury x 2
Dismissed – March 2020
Details:  After reviewing evidence and showing that alleged victims participated in the assaultive conduct (mutual combat defense) the State dismissed.

  • Details: After showing that client was actually a victim of the complaining witness, the State dismissed.

  • Details: After questioning the issue of whether or not speed in and of itself could be the basis of a reckless driving charge, the case dismissed prior to setting for trial.

  • Details: After multiple trial settings and ultimately picking a jury, the case was dismissed after the defense’s Motion to Suppress Evidence was granted by the Court.
